Municipal Court Records

City Court Records

Municipal court records are records which cities, municipalities and other local authorities keep of legal filings and court proceedings. Court records for a city generally involve arrest records, property records, criminal and civil court records of all sorts and the minutes from public meetings.

Obtaining court records from a municipality isn’t much different than collecing information from the county and state archives. You’ll mainly need to know the contact information for the city whose records you want, as well as which city official you need to visit, write or speak with.

Researching Public Records

Generally speaking, most municipal court records are going to be public information which you can access, unless the municipality is keeping records for a third party, there are specific records where protecting the identity of a person is considered valid, or when the records are considered of a “transitory” nature, meaning they can be thrown away when their immediate use is over.

This might be receipts for taxes or fines, notes from a public meeting, letters or transitory emails. (Certain city official’s emails must be preserved.) Records which should be kept under most freedom of information statutes are those which might have future administrative, legal, financial, historical or research value to the people of the city.

There are all types of municipal court records, including but not restricted to the following.

  • Notes
  • Papers
  • Letters
  • Vouchers
  • Receipts
  • Books
  • Documents
  • Images
  • Photographs
  • Audio-visual recordings
  • X-rays
  • Maps
  • Drawings

In the case of municipal records involving newer forms of communication, like faxes and emails, the public records laws are going to be less uniform. As a general rule, though city official emails and faxes involving record recommendations, opinions, approval of some policies, business transactions or decisions on city business should be maintained for the public record of the municipality. Researching these records might be difficult, unless you know your specific rights according to federal, state and local authorities.

Obtaining Municipal Court Records

Obtaining municipal court records is much simpler. All you have to do is have the official who keeps the records or the building these records are kept and then contact this individual or individuals. Have your information ready on the person whose court records you want to research or on the specific court case you want to learn about.

Once you apply for a court record, the city clerk or court clerk will find your court records and allow you to search the files. You can then take the notes you need. If you want to have your own copy of the record, you might have to pay a small fee to pay for the copy or for court fees. These should be relatively small and affordable. You might have to sign certain waivers, but know this is pretty standard.

County Court Records

If you can’t find the information you’re looking for by searching the municipal court records, look in the county court records. Many of the legal transactions you might normally associate with a city will actually be handled by a count, including marriages, divorces and even certain traffic tickets. If you can’t find a record, whether it’s on the municipal, county, state or federal level, you probably just haven’t look in the right place yet.
