Criminal background checks performed by potential employers will check several different types of crime files. When you apply for a job with a company and they perform a criminal background check on you, they will probably check to see your criminal history in five different areas: warrants, arrests, misdemeanors, felonies and sex offenses.
Depending on the type of work you’re expected to perform and the company policies, any one might disqualify you from the job.
Criminal Background Check of Misdemeanors
If you have a history of misdemeanors, they might not hurt you as much as the other legal problems on the list. For one, a misdemeanor is not considered as serious as most of the other crimes on this list. Two, not all companies are going to check misdemeanors. Three, certain states seal conviction records on certain types of misdemeanors, like drug possession.
So if you have a misdemeanor conviction or series of them, criminal background checks do not necessarily hurt your employment possibilities. At the same time, a criminal history check could. If the company you apply at has a no tolerance policy on drugs and you live in a state that allows criminal background checks to access your drug possession convictions, that could be a problem for your future employment.
Criminal Background Checks – New Warrants
A criminal background check on your outstanding warrants might be done. Usually, the search will only be for current warrants. Often, a company will only perform research on warrants in the state you live or work. Therefore, if you live in California and you have an outstanding warrant in Arizona, it may not be a problem for you.
Criminal Background Check on Arrests
In criminal background checks for most firms, the research goes back for 7 years. So if you have been arrested on a misdemeanor anytime within the past seven years, an instant criminal background check will show the arrest. Once again, depending on the type of arrest, this could be trouble for your employment status.
State Criminal Background Check – Felonies
When researching felonies, any felony arrest you have had in your life is likely to come up on a background check. There is no 7 year limit on the information. Since felonies are the most serious crimes, it’s assumed that any felony arrest or conviction is going to have a bearing on the kind of job you’ll perform, or the amount of danger the business or its employees might be in from theft or violence.
Background and Criminal Checks – Sex Offenses
Like felonies, a criminal background check is going to report any sex offense arrests you’ve been involved in during your lifetime, generally by checking sex offender criminal registries. When you are going to be around children, the sex crime background check is most important. Such criminal history might not be as important if you’re applying for other types of jobs.
Free Criminal Background Checks
If you are a small business and you don’t want to pay an arm and a leg for employment criminal background checks, you can search perform informal criminal background checks online for a little bit of nothing – often for free. Small subscriptions of $20 or $30 at an online criminal background check website will get you through until you learn the system well enough to find a list of trustworthy sites where you can perform free criminal background checks of your own.
